It is no secret that the General Data Protection Regulation (GDPR) contains no direct obligations for manufacturers of products, services and applications. Manufacturers, according to Recital 78 to the GDPR, are merely “… encouraged to take into account the right to data protection when developing and designing such products, services and applications …” But companies which rely on this fact and fail to take data protection into account in developing their products are ignoring their indirect obligation to implement the GDPR, which may be derived e.g. from contract law or from the laws governing manufacturer’s liability. The potential legal consequences of violations consist primarily of lawsuits from customers and data subjects, but data protection authorities are increasingly discussing the possibility of issuing product warnings as well.
In our digital business brunch, we will provide information about this current topic and offer concrete assistance to help manufacturers identify and implement requirements in data protection law. Adequate consideration will also be given to technical data protection requirements.
