Busi­ness Brunch – the cur­rent sta­te of pro­duct lia­bi­li­ty and pro­duct safety

Pro­duct safe­ty law is always on the move. Whe­ther it rela­tes to the use of sub­s­tances from the REACH and Bio­ci­dal Pro­ducts Regu­la­ti­ons, the Con­su­mer Goods Ordi­nan­ce or the rele­vant sec­tion of the Tim­ber Regu­la­ti­on, or is part of the ran­ge of pro­duct safe­ty law regu­la­ti­ons under the Ger­man Pro­duct Safe­ty Act (ProdSG) and the Radio Equip­ment Act (FuAG), which has been in force sin­ce 2017 – public law with regard to the pla­cing of pro­ducts on the mar­ket is sub­ject to con­ti­nu­al chan­ge.
This leads to various legal ques­ti­ons which we would like to examine:

  • distinc­tion bet­ween con­su­mer pro­duct and migra­ti­on product
  • sub­stan­tia­ti­on of label­ling regu­la­ti­ons by civil law judgements
  • label­ling regu­la­ti­ons under the FuAG
  • demar­ca­ti­on to the toy directive
