For the first time, the EU legislator has created harmonised rules for the safe and transparent use of AI systems and models in the EU market with the Regulation on Artificial Intelligence (Regulation (EU) 2024/1689) (AI Act). The new requirements present challenges for companies aiming to provide AI oder AI-based products in the EU, whether they are based in the EU or not. The AI Act takes a risk-based approach, imposing different levels of obligation depending on the type of AI system or model and the operator’s role in the supply chain (e.g. provider, deployer, importer or distributor). Companies wishing to place AI or AI-based products or services in the EU must comply with the new obligations. The supply chain is also becoming a focus of the AI Act.
New obligations from 2 August 2025
The AI Act has been in force since 1 August 2024. The new requirements will be introduced gradually. The rules on prohibited AI practices and AI competence have been in force since 2 February 2025. Further obligations for general-purpose AI (GPAI) models apply from 2 August 2025.
Many companies will face an initial hurdle in even assessing whether they are affected:
- Which AI systems do I use or develop?
- What role do I play within the scope of the AI Act?
- What obligations apply?
Clarifying early on whether you are affected is crucial to take timely measures to ensure compliance and avoid potential risks.
