Busi­ness Brunch digi­tal: Focus on the new Mar­ket Sur­veil­lan­ce Ordinance

Against the back­drop of incre­asing online trade, incre­asing­ly com­plex glo­bal sup­p­ly chains and a multi­tu­de of new busi­ness models, mar­ket sur­veil­lan­ce has faced con­sidera­ble pro­blems in recent deca­des that could not be pro­per­ly sol­ved on the basis of the old mar­ket sur­veil­lan­ce law. By way of Regu­la­ti­on (EU) 2019/1020 (MÜ-VO), aut­ho­ri­ties now have a legal frame­work adapt­ed to the­se new con­di­ti­ons, which has been legal­ly bin­ding in all mem­ber sta­tes sin­ce 16 July 2021. In addi­ti­on to new eco­no­mic actors and respon­si­ble par­ties who can be held accoun­ta­ble by the aut­ho­ri­ties, online com­mer­ce will now also be more tight­ly regu­la­ted and sub­ject to inter­ven­ti­on by aut­ho­ri­ties. In Ger­ma­ny, the Mar­ket Sur­veil­lan­ce Ordi­nan­ce (MÜ-VO) is flan­ked by the Act on Mar­ket Sur­veil­lan­ce and Assu­rance of Pro­ducts Con­for­mi­ty (MÜG), which regu­la­tes the admi­nis­tra­ti­ve inter­ven­ti­on opti­ons for non-harmonised pro­duct areas.
