The use of cloud ser­vices from the USA is part of ever­y­day life for many com­pa­nies, but sin­ce the ECJ’s Schrems II ruling at the latest, such use har­bors con­sidera­ble lia­bi­li­ty risks under data pro­tec­tion law. The new EU stan­dard con­trac­tu­al clau­ses are unli­kely to have chan­ged this. We pre­sent the cur­rent requi­re­ments for the trans­fer of per­so­nal data to third count­ries and pro­vi­de an over­view of the new EU stan­dard con­trac­tu­al clau­ses and their use, as well as addi­tio­nal requi­re­ments such as trans­fer impact assess­ments.
